TERMS AND CONDITIONS OF PURCHASE, DELIVERY, RETURN OF GOODS AND PROVISION OF 3D PRINTING SERVICES<\/strong><\/p> \n

1. General Provisions<\/strong><\/p> \n

1.1. These Terms and Conditions of Purchase, Delivery, Return of Goods and Provision of 3D Printing Services (hereinafter referred to as the Terms) establish the conditions governing the relationship between UAB \"Opeksas\" (hereinafter referred to as the Seller \/ Service Provider) and the Buyer \/ Client when goods are purchased and\/or 3D printing services are ordered through the online store or by other remote means.<\/p> \n

1.2. The Terms apply to natural persons purchasing for consumer purposes (hereinafter referred to as the Consumer) and to legal and natural persons acting for business or professional purposes (hereinafter referred to as the Business Client). Mandatory rights of Consumers established by the laws of the Republic of Lithuania may not be restricted by these Terms. <\/p> \n

1.3. Before placing an order, the Buyer must familiarize themselves with the Terms, Privacy Policy, and other information provided during the ordering process. By placing an order, the Buyer confirms that they have read and agree to these Terms. <\/p> \n

1.4. The Terms, together with the information provided during the ordering process, product description, price, delivery conditions, and, where applicable, individual offer, constitute the terms of the contract.<\/p> \n

1.5. The Terms may be amended. The edition of the Terms in force at the time of placing the order applies to that order, except where mandatory legal provisions provide otherwise. <\/p> \n

2. Information about the Seller<\/strong><\/p> \n

2.7. Data about the company is collected and stored in the Register of Legal Entities of the Republic of Lithuania. The data of the Register Centre and the Seller's details must be provided to the consumer before concluding a distance contract. <\/p> \n

3. Definitions<\/strong><\/p> \n

3.1. Goods \u2013 3D printer, 3D scanner, their parts, accessories, consumables and 3D printing materials, software if sold as a separate product, or other goods offered in the online store.<\/p> \n

3.2. Service \u2013 3D printing, model preparation, file verification, scanning, or other specifically ordered service provided by the Seller.<\/p> \n

3.3. Custom Order \u2013 Goods or 3D printing result manufactured according to a file, dimensions, color, material, design, or other individual specifications provided by the Client.<\/p> \n

3.4. Buyer \/ Client \u2013 Person entering into a contract with the Seller for Goods or Services.<\/p> \n

3.5. Consumer \u2013 Natural person entering into a contract for purposes other than business, trade, craft, or profession.<\/p> \n

3.6. Business Client \u2013 Legal entity entering into a contract for business, trade, craft, or professional purposes.<\/p> \n

4. Goods and Their Descriptions<\/strong><\/p> \n

4.1. The main characteristics of Goods, technical parameters, contents, manufacturer, model, price, and, where applicable, warranty information are indicated in the description of the specific Goods.<\/p> \n

4.2. Product images are illustrative unless otherwise stated. The representation of colors, textures, and packaging may differ due to screen settings or manufacturer changes. <\/p> \n

4.3. The contents of 3D printers and 3D scanners may vary depending on the specific manufacturer version, region, or model. The Buyer must refer to the specific product description and manufacturer documentation. <\/p> \n

4.4. The Seller may indicate that certain Goods are intended for professional use. Such information does not eliminate the Consumer's statutory rights if the Goods are purchased by a Consumer. <\/p> \n

4.5. If it becomes clear that the Goods cannot be delivered or are no longer available from the supplier, the Seller informs the Buyer and offers a replacement, alternative solution, or cancels the order. If the Buyer has already paid, the amounts paid are refunded in accordance with the procedure established by law. <\/p> \n

5. Placing an Order and Concluding a Contract<\/strong><\/p> \n

5.1. When placing an order, the Buyer selects Goods \/ Services, provides the necessary contact and delivery details, payment method, and other information required for the order.<\/p> \n

5.2. The Buyer is responsible for the accuracy of the data provided. If the data provided prevents the order from being fulfilled, the Seller may contact the Buyer to clarify it. <\/p> \n

5.3. Placing an order in the online store is not considered a guarantee that a specific item will always be in stock if, at the time of order confirmation, an actual stock, price, or other material error becomes apparent.<\/p> \n

5.4. The contract is considered concluded when the Seller confirms the order or begins to fulfill it, unless the law or the specific ordering process provides otherwise.<\/p> \n

5.5. The Buyer receives confirmation of receipt of the order by email. Order and contract data are stored in the Seller's information systems for the period established by law. <\/p> \n

5.6. If, due to an obvious technical or pricing error, the Seller cannot fulfill the order, they inform the Buyer and, where applicable, provide the option to choose the correct price or refuse the order. In the event of an obvious error, the Seller is not obliged to fulfill the contract at an obviously incorrect price if the Buyer understood or should have understood that the price was incorrect. <\/p> \n

6. Prices and Payment<\/strong><\/p> \n

6.1. Prices for Goods and Services are indicated in euros. Unless otherwise stated, the final price including applicable VAT is provided to the consumer. <\/p> \n

6.2. Prices for delivery, packaging, additional installation, calibration, scanning, model preparation, or other services are indicated before the Buyer places the order.<\/p> \n

6.3. The Seller may change prices before the contract is concluded. The price established in the contract applies to the contract already concluded, except in cases provided for by law. <\/p> \n

6.4. Payment methods: bank transfer, card, electronic banking.<\/p> \n

6.5. The order begins to be fulfilled according to the conditions of the selected payment method. The start of fulfillment of a custom 3D printing order is considered to occur after full payment, unless the parties agree otherwise. <\/p> \n

6.6. A VAT invoice is provided electronically to the Buyer's specified email address, unless the law provides otherwise. <\/p> \n

7. Delivery and Transfer of Goods<\/strong><\/p> \n

7.1. Delivery methods, terms, and prices are provided during the ordering process. The Seller may use the services of couriers, parcel lockers, or other transport service providers. <\/p> \n

7.2. Unless otherwise agreed, the Goods are delivered to the consumer no later than 30 days from the conclusion of the contract. If a different term applies to specific Goods, it must be clearly stated before concluding the contract. <\/p> \n

7.3. The Buyer must provide the exact delivery address, the name and surname of the person receiving the goods, contact telephone number, and other information required for delivery.<\/p> \n

7.4. Upon receiving the shipment, the Buyer must check the packaging. If external damage is noticed, it must be recorded and, if possible, noted in the shipment documents or the damaged shipment must be refused. <\/p> \n

7.5. Goods are considered transferred to the Buyer when they are physically received by the Buyer or a person designated by them, except for exceptions provided for by law.<\/p> \n

7.6. If the Buyer does not receive the Goods within the agreed term, they must contact the Seller as soon as possible. The Seller takes reasonable steps to clarify and complete the delivery. <\/p> \n

7.7. 3D printers and scanners may be delivered in the original manufacturer's packaging. Before first use, the Buyer must read the manufacturer's instructions, installation and safety requirements. <\/p> \n

7.8. Installation, start-up, calibration, or training services are included only if they are clearly stated in the order.<\/p> \n

8. Ordering 3D Printing Services<\/strong><\/p> \n

8.1. A 3D printing service is ordered by submitting a 3D model file and specifying the desired material, color, dimensions \/ scale, infill, layer height, surface finish, quantity, deadline, and other requirements, if applicable.<\/p> \n

8.2. Acceptable file formats, file transfer method, and technical requirements are indicated on the Seller's website or in an individual offer. If the file is technically unsuitable, the Seller may request that it be corrected or offer a file preparation service. <\/p> \n

8.3. Before starting printing, the Seller provides a price quote. The price may depend on the amount of material, printing time, model size, complexity, supports, finishing, and other work. <\/p> \n

8.4. Upon the Buyer's confirmation of the individual offer, the Service begins to be provided according to the confirmed parameters. If an advance payment or full payment is required, this is indicated in the offer. <\/p> \n

8.5. 3D printing is a manufacturing process, so minor layer, support, color, surface, or dimensional deviations, printed product surface irregularities, and other surface irregularities characteristic of the selected technology and material may be visible. If a specific technical accuracy is agreed, it must be clearly recorded in the order. <\/p> \n

8.6. If the Client does not provide sufficient information regarding functional or aesthetic requirements, the Seller prints according to the confirmed file and standard parameters of the selected technology.<\/p> \n

8.7. If, for technical reasons, it is necessary to change printing parameters that do not have a material impact on the result, the Seller may adjust them. Material changes that alter the price or result require the Client's confirmation. <\/p> \n

9. 3D Models, Files, and Intellectual Property Rights<\/strong><\/p> \n

9.1. The Client confirms that they have the right to use the 3D model, file, logo, text, image, or other content provided to the Seller and have the right to order its printing.<\/p> \n

9.2. The Client is responsible for not infringing third-party copyrights, designs, trademarks, patents, and other rights. The Seller is not responsible for the legality of the content provided by the Client if the Seller did not know and had no reason to know about the infringement. <\/p> \n

9.3. If the Seller has reasonable doubts about the legality of the submitted file or order, they may suspend the order and request additional information.<\/p> \n

9.4. Files provided by the Client are used only to fulfill the order and are otherwise processed in accordance with the Privacy Policy and agreements concluded with the Client.<\/p> \n

9.5. The Seller does not have the right to publicly publish the Client's model or printing result for marketing purposes without the Client's separate consent, except in cases where the Client has given such permission.<\/p> \n

10. 3D Scanning and Related Services<\/strong><\/p> \n

10.1. If the Seller provides 3D scanning services, the specific scanning method, accuracy, file format, processing level, deadline, and price are determined individually or in the service description.<\/p> \n

10.2. The accuracy of the scanning result may be affected by the object's geometry, surface gloss, transparency, color, size, environmental conditions, and the selected technology. Only the accuracy that is clearly agreed is guaranteed. <\/p> \n

10.3. The Client must have the right to transfer the scanned object and order its digitization.<\/p> \n

10.4. The scanning result is transferred in the agreed digital format. If additional model retopology, CAD model creation, or other processing is required, this is considered a separate service unless otherwise stated. <\/p> \n

11. Right to Withdraw from a Distance Contract<\/strong><\/p> \n

11.1. The Consumer has the right to withdraw from a distance contract within 14 days without giving a reason, except for exceptions established by law.<\/p> \n

11.2. In the case of Goods, the period is usually calculated from the day on which the Consumer or a third party designated by them, other than the carrier, receives the Goods. If several goods are delivered separately in one order, the provisions of the Civil Code apply. <\/p> \n

11.3. In the case of Services, the Consumer does not have the right to withdraw from a fully or partially provided service if the service was ordered and has already begun to be performed, unless the parties agree otherwise.<\/p> \n

11.4. The right to withdraw from the contract does not apply to goods manufactured according to the Consumer's special instructions or clearly personalized, including 3D printed products manufactured individually according to the Client's file.<\/p> \n

11.5. Other exceptions apply only to the extent that they are established by law.<\/p> \n

12. Return of Goods and Refund<\/strong><\/p> \n

12.1. A Consumer who has lawfully withdrawn from a distance contract must return the Goods without delay and no later than 14 days from the submission of the notice of withdrawal from the contract, unless the Seller agrees to collect the Goods themselves.<\/p> \n

When returning quality, unused goods whose purchase period does not exceed 14 days, the following conditions must be observed:<\/p> \n

the returned goods must be in the original neat packaging;the goods must be unused and not damaged by the Buyer;the goods must not have lost their commercial appearance (labels undamaged, protective films not removed, etc.);the returned goods must be of the same contents as received by the Buyer;when returning goods, it is necessary to provide the purchase document, warranty card (if issued), and complete the return form.12.2. The Seller refunds to the Consumer the amounts paid by them, including standard delivery costs, in accordance with the procedure established by law. The refund is made no later than 14 days from the date of delivery of the goods to the Seller. If the Consumer has chosen a more expensive delivery method than the standard one offered by the Seller, the additional price difference is not refunded. <\/p> \n

12.3. Money is refunded using the same payment method that the Consumer used when paying, unless the Consumer expressly agrees to another method and does not incur additional costs as a result.<\/p> \n

12.4. The costs of returning Goods when the contract is withdrawn at the consumer's initiative are borne by the Consumer. If the Goods are of poor quality or the wrong Goods have been delivered, the return costs are borne by the Seller. <\/p> \n

13. Return of Custom-Made 3D Printed Products<\/strong><\/p> \n

13.1. For a 3D product manufactured individually according to a file provided by the Client or specific dimensions, color, material, or other choices, the Consumer's right to withdraw from the contract does not apply if the product falls within the exception for personalized goods established in the Civil Code.<\/p> \n

13.2. This exception does not apply if the Client purchases a pre-made standard product that is not personalized according to their choice.<\/p> \n

13.3. A custom product may be returned or repaired due to quality non-conformity, incorrect contents, manufacturing defect, or other grounds provided for by law.<\/p> \n

13.4. If the Client provides an incorrect file, wrong dimensions, or other inaccurate data and the Seller manufactures the product according to the confirmed order, the product is not considered of poor quality solely due to an error in the data provided by the Client.<\/p> \n

14. Quality, Warranty, and Non-Conformity of Goods<\/strong><\/p> \n

14.1. All goods sold by us are subject to consumer rights and seller liability for the quality of goods established in the laws of the Republic of Lithuania and the European Union.<\/p> \n

14.2. For certain goods, their manufacturers may also provide an additional commercial manufacturer's warranty. The term, conditions, scope, and warranty service procedure of such a warranty may vary depending on the specific manufacturer and product. <\/p> \n

If the manufacturer provides an additional warranty, its conditions can be found in the documentation provided by the manufacturer or on the manufacturer's official website.<\/p> \n

14.3. If the Goods do not conform to the contract, the Consumer has the right, in cases established by law, to demand that the Goods be repaired or replaced, the price proportionally reduced, or the contract terminated.<\/p> \n

14.4. Warranty service may include diagnostics, repair, software updates, or other procedures provided for by the manufacturer, depending on the specific Goods.<\/p> \n

14.5. The warranty and the Seller's liability do not apply to the extent that the defect was caused by improper use, mechanical damage, incorrect electrical voltage, liquids, improper storage conditions, incorrect consumables, unauthorized disassembly of the device, or other reasons for which the Seller is not responsible under the law. These circumstances do not eliminate the Consumer's rights if it is established that the defect did not arise due to them. <\/p> \n

14.6. In the case of 3D printers, consumables may include, among other things, filaments, resins, nozzles, printing platforms, and other parts whose wear depends on use. The specific status of a consumable part is determined according to the manufacturer's documentation and the characteristics of the specific Goods. <\/p> \n

14.7. When submitting a complaint, it is mandatory to provide the order number, Goods model, serial number (if applicable), description of the defect \/ non-conformity, photographs or video, and the desired solution.<\/p> \n

14.8. The Consumer's request regarding defective Goods is processed in accordance with the procedure and deadlines established by law.<\/p> \n

15. Warranty Conditions for 3D Printing Materials<\/strong><\/p> \n

15.1. The properties of 3D printing materials depend on the manufacturer, material type, batch, storage conditions, and printing parameters.<\/p> \n

15.2. Filaments, resins, and other materials must be stored according to the manufacturer's instructions. Improper storage may impair the printing result or render the product unsuitable for use. <\/p> \n

15.3. Opened, individually prepared, or otherwise altered materials may be returned only in cases provided for by law or if the Seller agrees in good faith.<\/p> \n

15.4. The Consumer must use materials according to the manufacturer's instructions, paying particular attention to the safety requirements for resins, solvents, heated materials, and other products.<\/p> \n

16. Warranty Conditions for 3D Printing Services and Manufactured Parts<\/strong><\/p> \n

16.1. Quality of 3D Printing Services<\/p> \n

16.1.1. UAB \"Opeksas\" (hereinafter referred to as the Service Provider) undertakes to provide 3D printing services professionally, carefully, and in accordance with the technical requirements agreed at the time of the Client's order.<\/p> \n

16.1.2. The result of the service must comply with the essential requirements specified in the Client's order confirmation, individual offer, or invoice: selected material, color, quantity, dimensions, manufacturing technology, and other clearly agreed parameters.<\/p> \n

16.1.3. If the Client does not provide specific technical requirements, the part is manufactured according to standard parameters selected by the Service Provider that are suitable for the specific material and printing technology.<\/p> \n

16.1.4. Characteristics inherent to 3D printing technology \u2013 layer visibility, minor surface irregularities, support marks, minor color or dimensional deviations, deformations, shrinkage, or other signs of the technological process \u2013 are not in themselves considered a service defect if they do not exceed the tolerances typical for the specific technology.<\/p> \n

16.1.5. If the Client requires specific dimensional accuracy, mechanical resistance, temperature resistance, load capacity, tightness, or other technical parameters, such parameters must be clearly agreed in writing in advance. The mere submission of a 3D model file is not in itself considered a guarantee that the manufactured part will meet a specific functional or mechanical parameter if such a parameter was not agreed. <\/p> \n

16.2. Warranty for Manufactured Parts<\/p> \n

16.2.1. The Service Provider provides a 2-month commercial quality warranty for the manufactured part, calculated from the transfer of the part to the Client, unless a longer term is established in the individual order.<\/p> \n

16.2.3. The commercial quality warranty applies to defects arising from the manufacturing process performed by the Service Provider, improperly selected or used manufacturing parameters, or other circumstances for which the Service Provider is responsible under the law.<\/p> \n

16.2.4. If it is established that the part was not manufactured according to the Client's confirmed order, agreed parameters, or has a manufacturing defect, the Service Provider, at their discretion, taking into account applicable laws and the specific situation, may:<\/p> \n
